土地使用方面的限制。哈薩克斯坦2003年頒佈的《土地法》規定,哈本國公民可以擁有和租賃農業用地、工業用地、商業用地以及住宅用地,但是外國個人和企業只能租賃農業用地,且租賃期限不得超過10年。
外資企業在原料、設備採購和基礎設施使用等方面常受到地方政府的種種限制,致使投資專案無法落實。由於哈薩克斯坦有關投資法規存在著很多變數,因此執法中表現出很大的隨意性。這都會使投資者不敢輕易做出投資決定。

Restriction on the land use

In 2003 Kazakhstan has promulgated the “land law” which stipulates that country citizens can have land and use it for leasing of agricultural, industrial, commercial and residential land.  Foreign individuals and enterprises can lease an agricultural land, but the lease is no more than 10 years. Foreign enterprises face restrictions on the procurement of raw materials, equipment and infrastructure on which local government have various restrictions. As a result investment projects cannot be implemented due to these restrictions. Due to the presence of a lot of variables related to investment regulations in Kazakhstan, the law enforcement has shown great randomness. This will make very hard for investors to make investment decisions.
